Law for the Prevention of Sexual Harassment (1998) - Summary
Sexual Harassment and Intimidation are criminal acts and civil injustices
according to the Law for Prevention of Sexual Harassment
What is sexual harassment?
¶ Threats where the required action is of a sexual nature (any laying of conditions whether a demand for an act or receipt of something).
¶ Obscene acts as defined by the criminal law (touching, exposing sexual organs, peeping, masturbation in front of another party).
¶ Derogatory or humiliating comments regarding someone's sex, sexuality or sexual orientation.
¶ Repeated suggestions of a sexual nature (spoken, hinted at, or by touching) to an employee who has indicated that such suggestions are unwanted.
¶ Repeated references that focus on sexuality of an employee who has indicated such references are unwanted (verbally, in writing or by action).
With regard to the last two paragraphs: it is not necessary to indicate non-agreement if there is an authority/therapist/teacher etc relationship. In the workplace, this refers to an employer/employee relationship.
What is Intimidation?
Worsening of working conditions of an employee (or acting on threats as stated in Paragraph 1, above). An attempt to influence and/or to pressure or threats against someone who has lodged a complaint or any of those close to the complainant with regard to sexual harassment.
Courses of Action available to someone who has been harassed (any or all of the below at the same time):
1. Lodging a complaint with the referent for sexual harassment (intro-organizational proceeding).
2. Lodging a complaint with the police of sexual harassment or intimidation (criminal proceeding) .
3. Lodging a civil suit in the labor courts (civil proceeding)
4. A call to the The Rape Crisis Center (from any telephone in Israel: dial 1202 or 1203) in order to get information, emotional and psychological support, guidance through the criminal process, support groups and more. NOTE: Calls from managers or victims can be treated as anonymous.
